I. Introduction: • This provider uses telehealth services to provide mental health, substance abuse counseling and SAP services. • We utilize a secure video conferencing platform, Simple Practice, LLC with end-to-end encryption to protect your telehealth sessions. • As a provider, we understand and recognize your biosocial and medical information are important personal matters. Bradbury Counseling and Consulting remains committed to protecting and safeguarding your biosocial and medical information. Requests for information are to be submitted in writing. II. Technology: • Technologies Used: Simple Practice, LLC will be used for telehealth services (e.g., video conferencing software, patient portals) and clients will be provided with a secure link to the session (e.g., encryption, secure storage). • Security Measures: Bradbury Counseling and Consulting utilizes Simple Practice, LLC’s Electronic Medical Record (EMR) / Electronic Health Record (EHR) software • Session documentations are contained within the client’s electronic health records. With the exception of SAP services and Alabama Supervision supervisees’ records, which are contained on site. • Third-Party Technologies: Bradbury Counseling and Consulting acknowledges the utilization of third-party technologies, which may have their own privacy and security practices and encourages clients to review those policies separately. • Data Breach Procedures: Data breaches will be handled in accordance with state laws, including patient notification. III. Client Privacy: • Client Rights: Clients have a right to access their protected health information, including evaluations, diagnoses, treatment planning, amendment, and the right to request restrictions on how information is used. Please note, session notes are excluded. • Confidentiality: You have the right to a safe, unbiased counseling service and experience. Limitations of confidentiality are restricted to direct or imminent danger to oneself or others, including expressed neglect of vulnerable populations (e.g., children or the elderly). Telehealth conversations are confidential except in specific, limited circumstances in which information may be disclosed (e.g., as required by law, to prevent harm). Specified services are protected by Federal law 42 CFR Part 2. Client Responsibility: Clients are encouraged to: • Use a private and secure location for telehealth consultations. • Use your own device, if possible, and avoid public or shared devices. • Disable any devices that may overhear or record the conversation. • Disclosing Information: • A signed written release of information must be obtained prior to the release of client information. The release must outline an identifiable person and or entity to receive client information. Moreover, the release should identify for how long the authorization remains in place or otherwise will be invalidated after 365 days. • Disclosure of client information is allowed by court order. • Disclosures made to medical personnel in a medical emergency or to qualified personnel for research, audit, or program evaluation. IV. Special Situations: •Payment and cancellation: Payments are due prior to the start of the session. Cancellations one hour or less prior to service will be charged. Three consecutive cancellations will result in an appropriate referral for services. •Legal Requirements: State that the provider may be required to disclose patient information in certain legal situations (e.g., court orders, public health reporting). Emergencies: Disclosures made to medical personnel in a medical emergency or to qualified personnel for research, audit, or program evaluation. •Children's Privacy: Children under 13 years of age, adherence to HIPAA guidelines, and the Children’s Online Privacy Protection Act (COPPA).
